These Terms of Service ("Terms") govern your use of the website www.cohabitationcontracts.co.za ("the Website") and the legal services offered through it by Louwrens Koen Attorneys ("the Firm", "we", "us", or "our"), a law firm duly registered and practising in the Republic of South Africa, with offices at 416 Kirkness Street, Arcadia, Pretoria.

By accessing or using this Website, or by engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website or our services.

1. Nature of Services

The Firm provides legal services relating to the drafting and notarial attestation of cohabitation / life partnership agreements. Our services include consultation, drafting, explanation of the agreement, attestation before a Notary Public, notarial certification, and allocation of a Protocol Number.

The information provided on this Website is for general informational purposes and does not constitute legal advice. The content on this Website should not be relied upon as a substitute for professional legal advice specific to your circumstances. A formal attorney-client relationship is only established once a written mandate has been accepted and a fee agreement has been concluded between you and the Firm.

2. Eligibility

By using this Website and engaging our services, you represent and warrant that:

  • All information you provide to us is accurate, complete, and truthful; and
  • You are not prohibited by any applicable law from entering into a cohabitation / life partnership agreement.

3. Online Application and Instructions

When you complete an online application form on this Website, you provide us with instructions to draft a cohabitation / life partnership agreement based on the information you supply. You are responsible for ensuring that all information provided is accurate and complete.

The submission of an online application does not create an attorney-client relationship. An attorney-client relationship is established only once we have accepted your instructions, confirmed our mandate, and you have agreed to our fee.

We reserve the right to decline instructions at our discretion, including but not limited to circumstances where we identify a conflict of interest, where the instructions are unlawful, or where we are unable to verify the identity of the parties.

4. Fees and Payment

Our current all-inclusive fee for the drafting and notarial attestation of a cohabitation / life partnership agreement is R1 700.00 (one thousand seven hundred rand). This fee includes consultation, drafting, explanation, attestation before a Notary Public, notarial certified copies of identity documents / passports, notarial binding, and allocation of a Protocol Number.

Fees are subject to change without prior notice. The fee applicable to your matter will be the fee confirmed to you at the time of acceptance of your instructions.

Payment is due prior to or at the time of the signing appointment, unless otherwise agreed in writing. We accept payment by electronic funds transfer (EFT), cash, or such other methods as we may communicate to you.

Should additional or unforeseen work be required beyond the standard scope of the service (for example, complex or unusual clauses, amendments after the draft has been finalised, or additional consultations), we reserve the right to charge additional fees, which will be communicated to you in advance.

5. Signing Requirements and Attendance

Both parties to the cohabitation / life partnership agreement must appear in person at our offices in Pretoria to sign the agreement in the presence of the Notary Public. This is a legal requirement for the notarial attestation of the agreement.

Each party must bring their original identity document (South African ID for citizens, valid passport for foreign nationals). If either party has been previously married, a certified copy of the final decree of divorce must be provided.

We cannot proceed with the notarial attestation if either party fails to appear in person or fails to produce the required identity documents.

6. Accuracy of Information

You warrant that all information provided to us, whether through the online application form, email, telephone, or in person, is true, accurate, and complete. We rely on the information you provide to draft your agreement and cannot be held liable for any errors, omissions, or consequences arising from inaccurate or incomplete information supplied by you.

If any information changes between the time of your application and the signing appointment, you must notify us immediately so that the agreement can be amended accordingly.

7. No Guarantee of Visa Approval

While a notarial cohabitation / life partnership agreement is a requirement for a Life Partner Visa application under Section 11(6) of the Immigration Act 13 of 2002, we make no representation, warranty, or guarantee that the execution of a cohabitation agreement will result in the approval of any visa, permit, or immigration application.

The decision to grant or refuse a visa or permit rests solely with the Department of Home Affairs. We are not immigration consultants and do not provide immigration advice. Our service is limited to the drafting and notarial attestation of the cohabitation / life partnership agreement.

8. Limitation of Liability

To the fullest extent permitted by law:

  • The Firm shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of this Website or the engagement of our services;
  • The Firm's total liability in respect of any claim arising from our services shall not exceed the fee paid by you for those services;
  • The Firm shall not be liable for any loss or damage arising from your reliance on general information published on this Website;
  • The Firm shall not be liable for any delay, refusal, or outcome of any visa, permit, or immigration application submitted to the Department of Home Affairs or any other government authority; and
  • The Firm shall not be liable for any consequences arising from inaccurate, incomplete, or misleading information provided by you.

If you wish to cancel after the draft agreement has been prepared but before the signing appointment, a cancellation fee may be charged to cover the work already performed. The amount will be communicated to you at the time of cancellation.

No refund will be provided after the agreement has been signed and notarially attested, as the service will have been fully rendered.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa, specifically the Gauteng Division of the High Court, Pretoria, or the Magistrate's Court having jurisdiction.

16. Amendments to These Terms

We reserve the right to amend these Terms at any time. Any amendments will be effective immediately upon publication on this Website. Your continued use of this Website after the publication of amended Terms constitutes your acceptance of the amended Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
